Extension and variation to residential tenancy agreements
The Residential Tenancies Act has been amended to make renewing or extending a tenancy agreement more simple.
From now on, a new tenancy agreement doesn’t have to be arranged; instead the parties can renew or extend the agreement simply by confirming the material changes to the agreement in writing.
The REIWA form 347 ‘Extensions and variation of residential tenancy agreement’ can be used for this purpose.
An agreement can only be varied or extended prior to the termination date.
If the tenancy has terminated then a new lease will have to be entered into.
